Corneliu-Liviu Popescu, L'inconventionnalité et l'inconstitutionnalité des dispositions législatives concernant le retrait de la nationalité roumaine pour des motifs visant la sécurité nationale ou le terrorisme

Résumée: La Loi no 21/1991 sur la nationalité roumaine, prise conjointement avec l'Ordonnance d'urgence du Gouvernement no 5/2010 portant création, organisation et fonctionnement de l'Autorité nationale pour nationalité, avec la Loi no 51/1991 portant sécurité nationale de la Roumanie, avec la Loi no 535/2004 portant prévention et lutte contre le terrorisme, avec la Loi no 182/2002 portant protection des informations classées et avec la Loi no 554/2004 du contentieux administratif, permet de retirer la nationalité roumaine pour des motifs liés à la sécurité nationale ou au terrorisme. Cette mesure a un caractère "pénal" au sens européen autonome.

La législation en la matière est vague, imprécise et lacunaire et elle n'offre pas des garanties contre l'arbitraire.             La procédure a une nature administrative, la décision administrative portant retrait de la nationalité relevant de la compétence du président de l'Autorité nationale pour nationalité, avec la possibilité d'une action en annulation en contentieux administratif, devant le tribunal judiciaire de contentieux administratif. La procédure de contentieux administratif est basée sur la présomption de légalité de l'acte administratif contesté et ne contient pas des règles expresses sur l'accès aux informations classées qui ont déterminé la décision, et le jugement de première instance est définitif.

En outre, pour les mêmes faits, une condamnation pénale de la personne à des peines d'emprisonnement, pour des infractions pénales concernant la sécurité nationale de la Roumanie ou le terrorisme, est possible. Après le retrait de la nationalité roumaine, la personne en question peut être expulsée et/ou on peut lui interdire l'accès au territoire national.

En conséquence, les textes légaux applicables sont inconstitutionnels et également en violation de la légalité pénale, du droit à un procès pénal équitable - le caractère judiciaire de la condamnation, l'égalité des armes, la présomption d'innocence, les droits de la défense, le double degré de juridiction, non bis in idem - et du droit au respect de la vie privée et familiale, à savoir des articles 6, 7 et 8 de la Convention européenne des droits de l'homme et 2 et 4 du Protocole additionnel no 7 à la Convention.

Gabriel Andreescu, The collaborationism with the repressive institutions of the communist regime

Abstract: The study argues about the need to change the current system of declassification and to rebuild it in the framework of the ethics and politics of memory. Among the proposals: the inclusion of the agents of a broader range of institutions or institutional entities acting as communist political police; the separation of the disclosure procedures for informers from those of the Securitate officers; reversing the burden of proof with regard to the Securitate agents; the use of two separate tests meant to define collaborationism - the test of human rights infringement and the test of assisting the repressive institutions; the introduction of a category of persons paradoxically absent in the actual law - the "agents of influence who collaborated with the Securitate"; the separation of the topics ”knowledge of the past”, which is a matter of disclosure, and ”evaluation of responsibilities”, which belongs to the lustration issue.

By analyzing the Nicolae Breban case, I highlighted the need to introduce criteria of proportionality and reasonability, and I introduced the following questions as evaluation criteria on collaborationism: (a) did the person act on the basis of the requirements of Securitate?; (b) did he or she act to promote the regime's interests contrary to those of certain individuals or the society?; (c) did the person keep contact with the Securitate and follow its requests in a systematic and coherent way?, etc. Taking as starting point the ruling of the Bucharest Court of Appeal in the Nicolae Breban case, and his appeal to this ruling, I could establish some conclusions regarding the documenting process and admissible proofs in connection with the collaborationist cases.

Roxana Prisacariu, Roma and Romanian: freedom of opinion and discrimination

Abstract: The equal treatment of the person expressing their subjective judgements is unanimously accepted. Nevertheless, similar behaviours in comparable circumstances from persons belonging to vulnerable or dominant groups seem to be treated differently in societies in which there are historical inequalities. Beginning from two examples of potentially depreciative public messages, the study discusses some arguments and counterarguments for a different juridical treatment of people pertaining to vulnerable or majority groups in comparable situations. The developed reasoning starts from the equality principle applied in the Romanian context, using arguments from the Strasbourg Court jurisprudence and from the literature on asymmetrical and institutional discrimination.
